Can the Common Areas be subdivided for other building lots or sold?

The Common Areas have been established for the use and enjoyment of the residents of Salem Hills and other entities upon request. According to the bylaws, the Common Areas can be transferred to a non-profit corporation, association, trust or other organization devoted to purposes of promoting the recreation, health, safety and welfare of the residents.  The Association also has the power to sell or transfer all or part of the Common Area to any public agency, authority, or utility for such purposes and subject to such conditions as may be agreed to by the Members.  It is understood this means no builders, investors or other such private companies or persons could be the recipient of the Common Areas from sale or transfer.  

In addition, it is understood that some of the lots in Salem Hills are smaller than was required during the time of the development approval in the 1960's.  As such, the Common Areas were established to offset these smaller lots, and also qualified Salem Hills as cluster zoning.  As a result, Salem Hills residents benefit from reduced property taxation due to cluster zoning.
